VIRGINIA BEACH — A local business owner who pleaded guilty to a child pornography charge is filing an appeal, claiming he received ineffective advice from his attorney, according to federal court documents.

Virginia Beach Police began an undercover investigation of Joshua Lazernick’s IP address at his then-place of business, All Around Pizza and Deli, in July 2014, according to court documents. After officers had gathered enough evidence, police searched All Around in December 2016 and found devices which contained child pornography. A grand jury later indicted Lazernick in March 2017 on four counts of receiving child pornography and one count of possession of child pornography.

All Around still operates, but under different ownership, said an employee at the restaurant.

Lazernick’s case was was handled by Assistant U.S. Attorney Elizabeth Yusi.

In a plea deal with Yusi’s office in June 2017, Lazernick pleaded guilty to one count of receiving child pornography. U.S. District Judge Raymond Jackson later sentenced Lazernick to 10-½ years in prison, with 20 years of supervised probation. 

Lazernick’s appeal was filed Fernando Galindo, Clerk of the U.S. District Court in Norfolk on Monday. Attorneys for Lazernick declined to comment about the appeal.
