methVIRGINIA BEACH — A 31-year-old Chesapeake man is facing federal charges after police say he was caught with meth and distribution materials outside of a Virginia Beach strip club.

William Russell “Rusty” Hilton II was charged with possession with intent to distribute methamphetamine and criminal forfeiture in the Eastern District of Virginia on Jan. 25.

He was arrested by the Virginia Beach Police Department on Oct. 28, 2016 and charged with possession with intent to distribute a schedule I, II drug and possession of meth with the intent to sell it.

Those charges were nolle prossed in Virginia Beach General District Court on Feb. 10. When a charge is nolle prossed, prosecutors agree not to pursue the charge unless further evidence is presented.

Courthouse spokeswoman Macie Allen said that the charges were nolle prossed because the federal courts adopted the case.

Records filed in the Eastern District of Virginia show that federal officials were investigating Hilton during his Virginia Beach court proceedings.

Police say on Oct. 28, 2016, Hilton was sitting in the driver’s seat of a parked 2002 Audi outside of Minx Gentlemen’s Club, located at 446 Oceana Blvd. Virginia Beach police officers were doing a routine patrol of the area around 12:30 a.m. when they noticed the car with the driver’s side door open, court documents state.

An officer approaching the car reported seeing Hilton hide an item under his leg while holding a bundle of money wrapped up in a band.

Another officer asked Hilton if he was at the club to work or to go to a show. Hilton said he was there for a show and got out of the car. As he got out, an officer saw a small plastic bag filled with a white substance on the driver’s seat where Hilton had been sitting, court documents state.

Hilton was taken into custody and police searched his car. Inside they found a safe, digital scale, $3,737, suspected heroin, suspected marijuana and 58 grams of meth.

Hilton was granted a $5,000 bond by a federal judge. His case is scheduled for trial on June 6.
